Risk Activities Annex

01Scope

This Annex forms an integral part of the Terms and Conditions of Tourevo (tourevo.cl, with its commercial domicile in Santiago, Chile), of every quote, proposal and booking. It applies to every experience that involves an inherent risk to the passenger's physical integrity because of the nature of the activity, the environment in which it takes place or the weather or geographical conditions of the location: in particular those in section 3, without that list being exhaustive.

Transfers, city tours and urban visits are governed by the general Terms and Conditions; this Annex applies to them only as regards road travel (3.10) and passenger conduct (7).

02Definitions

Inherent risk: a risk that is part of the nature of an activity and remains even when the organiser, the operator and the passenger act with due care: a fall while skiing, a horse's reaction, a change of weather in the mountains, altitude sickness, turbulence.
Specialised Operator: the company or person, other than Tourevo, that directly carries out an activity with its own means, staff and licences: the air operator and its crew; the ski resort and its school; the mountain guide; the ranch and its horse guide; the nautical operator; the local operator of each destination outside the Central Zone; the winery and its staff.
Passenger: each person taking part in the activity. Whoever books for a group declares that they are authorised to accept this Annex on behalf of each member and undertakes to make it known to them before the activity.
Person in charge of the activity: the pilot, instructor, guide, horse guide, skipper or driver-guide in charge at any given time.

03Activities, inherent risks and conditions

Each activity has its own risks, and the passenger declares that they know them before booking. What follows is an informative description, not a closed list.

3.1 · Helicopter flights

Valle Nevado by Helicopter · Ski Resorts Scenic Flight · Snow Day by Helicopter · Heliski (flight segment).

Inherent risks: those of aviation (turbulence, sudden weather changes in the Andes, landings on unprepared ground above 2,500 m), noise, motion, altitude and cold.
Operator: the flight is provided by an air operator certified by Chile's Civil Aviation Authority (DGAC), with its own aircraft, crew and aviation insurance. The decision to fly, the route, the landing or the return are exclusively the pilot in command's.
Conditions: maximum weight per passenger and per flight set by the operator (each passenger's real weight is requested when booking); no boarding under the influence of alcohol or drugs; comply with the safety briefing; do not approach the aircraft without the crew's instruction; the minimum age is set by the operator and communicated when booking; pregnancy and heart or respiratory conditions must be reported and may prevent the flight.
Weather: a flight suspended because of weather or by the pilot's decision does not constitute a breach by Tourevo and is resolved in accordance with section 9.

3.2 · Heliski and off-piste guiding

Inherent risks: avalanches, uncontrolled and unmarked terrain, crevasses, hidden rocks, sudden changes of visibility, altitude, extreme cold, intense physical effort, injuries from falls.
Level requirement: exclusively for advanced skiers or snowboarders, able to descend any slope in untreated snow with control. The passenger declares that level under their own responsibility; the guide may verify it at the start and exclude anyone who does not have it, with no right to a refund for that day.
Safety equipment: the passenger agrees to carry and use avalanche equipment (transceiver, shovel and probe), to take part in the briefing and the prior check, and to follow the guide's instructions on route, order of descent, stopping points and distances without exception.
Guide: certified mountain guide. Their assessment of terrain and snow is final; they may modify, shorten or cancel the day's plan for safety, with no right to compensation.

3.3 · On-piste ski and snowboard

Ski or Snowboard Lessons at Valle Nevado · On-piste Snow Guiding · Farellones and ski resorts · Portillo.

Inherent risks: falls, collisions with other users or with elements of the slope, use of lifts, ice, altitude sickness (the resorts sit between 2,400 and 3,000 m), cold, sunburn; and the mountain road itself (bends, snow, use of chains, road closures by the authorities).
Operator: lessons are given by the resort's ski school with its instructors; the ski resort is a third party with its own rules, which the passenger accepts when buying their ticket. Lift ticket, equipment and boots are arranged directly with the resort, unless the quote expressly states that they are included.
Conditions: helmet recommended and mandatory for minors; declare your real level; respect slope rules and the instructions of the instructor or guide. The school's minimum age is set by the resort.

3.4 · Horseback riding

Inherent risks: a horse is an animal and reacts unpredictably; falls, knocks, being stepped on, bites, uneven ground, heat or cold, prolonged sun exposure.
Operator: the ranch and its horse guide, who assigns the horse according to the declared weight, height and experience and leads the ride.
Conditions: maximum weight set by the ranch and communicated when booking; helmet available and mandatory for minors; closed shoes and long trousers; keep the pace and distance set by the guide; riding under the influence of alcohol is not allowed; pregnancy and back problems must be reported.

3.5 · Water activities

Kayaking at Aculeo Lagoon · Boat or jet ski at Lake Rapel · Lake Colbún · boat trips at destinations.

Inherent risks: falling into the water and drowning, hypothermia, wind and waves, collisions, sunstroke, knocks when boarding or disembarking.
Operator: nautical operator with vessels and skipper licensed by the Maritime Authority.
Conditions: life jacket on throughout the whole trip, no exceptions; declare whether you can swim; no alcohol before or during; a jet ski is only driven by a holder of a valid licence or by the operator; the skipper may suspend for wind or weather.

3.6 · Mountain, altitude and hot springs · Central Zone

Cajón del Maipo · El Yeso Reservoir · Hot springs · Portillo.

Inherent risks: altitude (El Yeso Reservoir 2,500 m · Portillo 2,880 m): headache, nausea, shortness of breath; short walks on uneven ground; intense sun and cold; hot springs not advised for high blood pressure, pregnancy and heart conditions; mountain roads subject to closure by the authorities.
Rafting (Cajón del Maipo): optional activity, booked and paid directly to the rafting operator, with its own conditions and its own consent form; Tourevo only coordinates the timing.

3.7 · Destinations outside the Central Zone · local operator

Atacama · Torres del Paine · Elqui Valley · Rapa Nui · Chiloé.

Who provides the service: outside the Central Zone Tourevo does not operate: it selects, books on the passenger's behalf and coordinates a local operator, which provides the transport, the guiding and the activity with its own means and under its own responsibility. Tourevo answers for the diligence of the selection and for the coordination.
Inherent risks: Atacama, extreme altitude (San Pedro 2,400 m · El Tatio geysers 4,300 m: altitude sickness, cardiac risk), desert (sun, dehydration, temperature swings); Patagonia, extreme and changing weather, wind, trekking on uneven ground, park closures; Chiloé, boat trips (3.5); Elqui, moderate altitude and pisco tasting (3.8); Rapa Nui, sun, volcanic terrain, surf.
Conditions: report heart or respiratory conditions or pregnancy before booking Atacama; follow the local guide's instructions; hold travel insurance (13).

3.8 · Wineries, gastronomy and alcohol

Winery tours, Wine Days, food-and-wine experiences, Santiago Gourmet, Elqui and pisco.

Inherent risks: those of drinking alcohol (intoxication, falls, interaction with medication), food allergies and intolerances, walking through cellars, vineyards and stairs.
Conditions: only adults over 18 drink alcohol; the passenger drinks under their own responsibility and in moderation; no passenger drives: Tourevo provides the transport for the whole day; tastings and meals are provided by the winery and the restaurant, which answer for them; allergies are reported when booking. Tourevo may refuse entry to a winery or end the day for anyone whose condition puts people, property or the group itself at risk (7).

3.9 · Coast, beaches and hills

Inherent risks: swimming in the sea on beaches with currents and waves (most central-coast beaches are not suitable for swimming), rocky shores, stairs and slopes on the hills, sun.
Conditions: swimming in the sea is the passenger's free decision, outside the contracted service and at their sole risk; the signage at each beach should be respected.

3.10 · Road travel · all experiences

Inherent risks: those of road traffic. Tourevo drives with professional drivers and its own vehicles with a valid technical inspection, registration and the mandatory personal accident insurance (SOAP).
Conditions: seat belt on at all times; minors in a car seat or booster as required by Chilean law (Tourevo provides one if requested when booking); no smoking or drinking alcohol inside the vehicle.

3.11 · Parks and animals

Contact with animals is governed by the park's rules, the park being a third party. The passenger accepts those rules on entry.

04What Tourevo undertakes to do

To provide with its own means the transport, the driver-guide and the coordination of each experience, with the standard of care the law requires of a professional provider.
To contract only Specialised Operators licensed for their activity (DGAC-certified air operators, authorised ski resorts and schools, certified guides, nautical operators with licensed vessels and skippers, registered local operators), and to tell the passenger, on request, who provides each service.
To inform, before booking, of the inherent risks and particular conditions of each activity (this Annex, the product page and the quote), and to inform again before the activity through the briefing by the person in charge.
To suspend, modify or cancel any activity when safety conditions are not met, without that decision constituting a breach.
To deal with any emergency with due care (14).

05Passenger declarations

When booking, and again when signing the informed consent before the activity, each passenger declares:

That they have read and understood this Annex and the description of the activity, and have had the opportunity to ask questions.
That they are in adequate physical and health condition for the activity, that they suffer from no condition that contraindicates it and that they have reported in writing any relevant condition (heart, respiratory, neurological, back, pregnancy, allergies, medication).
That the information on their weight, height, age, level of experience and ability to swim is true.
That they will not take part under the influence of alcohol, drugs or medication that impairs their ability.
That they know the scope of the insurance coverage described in section 13 and that they have been advised to hold travel insurance covering adventure activities.
That, if booking for others, they are authorised to accept this Annex on their behalf and have given them its content.

06Assumption of inherent risks

The passenger knows and voluntarily assumes the inherent risks of the activity they book, described in section 3, and accepts that injuries, illness or damage may occur even when Tourevo, the Specialised Operator and the passenger themselves act with due care.

Consequently, the passenger accepts that Tourevo is not liable for damage arising exclusively from an inherent risk, from the passenger's own conduct (7), from inaccurate statements on their part (5), from an act of God or force majeure (9) or from the act of a third party unrelated to the service.

This assumption does not cover damage caused by wilful misconduct or negligence of Tourevo or of the persons for whom it answers, nor does it limit the rights that Chilean Law 19,496 grants consumers as non-waivable (16).

07Instructions, conduct and right of exclusion

The passenger undertakes to follow at all times the instructions of the person in charge of the activity, to use the safety equipment indicated to them (life jacket, helmet, avalanche transceiver, seat belt) and to respect the rules of the venue (ski resort, ranch, winery, park, vessel).

The person in charge may exclude from the activity, suspend it or end it for a passenger who disregards instructions, turns up under the influence of alcohol or drugs, conceals a relevant health condition or puts people or property at risk. In that case there is no refund for the activity not carried out for that reason, without prejudice to Tourevo's right to recover from the passenger the costs and damage caused by their conduct.

Damage to the vehicle, to rented equipment or to third-party property caused by the passenger's conduct is at the passenger's expense.

08Specialised Operators

The passenger is informed and accepts that the activities described in 3.1 to 3.7 and 3.11 are carried out by a Specialised Operator, which answers for the activity it provides, its means, its staff, its equipment and its licences, and which may require the passenger to accept its own conditions and consent forms.

Tourevo answers for the diligent selection of the Operator, for the coordination of the activity and for what Tourevo carries out with its own means. The above does not alter the rights the law grants the passenger against each provider.

09Weather, safety and force majeure

Risk activities depend on the weather, on the condition of the mountain, the sea or the roads, and on safety decisions by the person in charge or by the authorities (closure of roads, the park, the ski resort, aviation restrictions). Suspension, modification or cancellation for those reasons does not constitute a breach by Tourevo or the Operator.

In those cases Tourevo offers, in accordance with its cancellation options policy, rescheduling, a credit or a refund of the part of the service not provided, less costs already committed to third parties and not recoverable, according to how much of the service was actually provided. No additional compensation is due for loss of profit, travel expenses, accommodation or flights unrelated to the service.

The decision to suspend for safety belongs to the person in charge (pilot, guide, instructor, horse guide or skipper) and not to the passenger. Insisting on carrying out the activity against that decision is not allowed.

10Minors

Minors under 18 take part only accompanied by their father, mother or guardian, or with that person's written authorisation, who accepts this Annex on their behalf and answers for their conduct.

The minimum age for each activity is set by each Operator and communicated when booking. Heliski, off-piste guiding and driving jet skis are for adults over 18 only. Minors wear a helmet when skiing and riding and a life jacket on every boat trip.

Minors do not drink alcohol on any experience.

11Alcohol and substances

Taking part in air, snow, horseback, water or mountain activities under the influence of alcohol or drugs is prohibited. On tasting experiences (3.8) drinking is voluntary, moderate and the passenger's own responsibility.

12Equipment and belongings

Equipment provided by Tourevo or by the Operator (helmet, life jacket, avalanche transceiver, ski equipment, saddle) must be used as instructed and returned in the condition received; its loss or damage through misuse is at the passenger's expense.

Tourevo is not responsible for personal items left in the vehicle, at the ski resort, at the winery or at the activity venue, unless they were expressly handed to the driver-guide for safekeeping.

13Insurance

Tourevo's vehicles carry the Mandatory Personal Accident Insurance (SOAP) required by Chilean law, which covers occupants in the event of a road accident under its conditions.

The insurance coverage included in each experience, if any, is detailed in the proposal. Tourevo expressly recommends taking out travel insurance that covers adventure activities (snow, mountain, helicopter, water, horseback riding), medical expenses, evacuation and repatriation. Specialised Operators may hold their own insurance, the scope of which each one communicates.

14Emergencies and health data

The passenger gives Tourevo an emergency contact and authorises Tourevo and the Operator to request medical assistance, transport or evacuation on their behalf if their condition requires it and they are unable to decide, the costs of that assistance not covered by insurance being borne by the passenger.

Health data reported by the passenger is used only for the safety of the activity, shared only with the person in charge who needs it and processed in accordance with Tourevo's privacy policy and Chilean Law 19,628.

15Images

Tourevo may take photographs or video during the activity. Their use for promotional purposes requires the passenger's express authorisation, which may be refused without any consequence.

16Legal limits

Nothing in this Annex excludes or limits Tourevo's liability for wilful misconduct or negligence, its own or that of the persons for whom it answers, nor the rights that Chilean Law 19,496 and other rules grant consumers as non-waivable. If any clause is declared void or unfair, the others remain valid.

17Acceptance

This Annex is accepted before payment: at the Tourevo Pay checkout and in the client portal, when the booking includes an activity that requires it, the person paying accepts it on behalf of all passengers in the booking, and Tourevo records the date, the version accepted and the channel. For the activities in sections 3.1 to 3.7 it is also ratified in writing before the activity through the Informed Consent Form, one per passenger. Without that signed form, the Operator may refuse participation with no right to a refund.

18Governing law and jurisdiction

This Annex is governed by Chilean law. The competent court is that of Tourevo's domicile, without prejudice to the consumer's right to go to the National Consumer Service (SERNAC) and to the local police court determined by Law 19,496.
